Privacy Policy

This privacy notice explains how Merlin Fuchs ("we," "us," or "our") collects, stores, uses, and shares your information when you use Embed Generator, our website at https://message.style, or any other service of ours that links to this notice (the "Services").

If you do not agree with our policies and practices, please do not use our Services. If you have any questions or concerns, contact us at privacy@message.style.

Information We Collect​

We collect personal information that you provide to us when you register, use the Services, or contact us. Depending on how you use the Services this may include:

  • email addresses
  • usernames
  • names
  • billing addresses
  • payment card details
  • contact preferences
  • contact or authentication data

We do not process sensitive personal information.

Payment data. If you make a purchase, we collect the data necessary to process your payment. All payment data is stored by Stripe, we never store your card details ourselves.

Discord login data. You register and log in with your Discord account. Discord provides us with profile information such as your user ID, username, avatar, email address, and the servers you have access to. See How We Handle Your Discord Login below.

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to it.

Information Collected Automatically​

Some information is collected automatically when you visit or use the Services. It may include:

  • Log and usage data. Service-related, diagnostic, usage, and performance information our servers record in log files. Depending on how you interact with us, this may include your IP address, device information, browser type and settings, the pages and features you use, timestamps, and error reports.
  • Device data. Information about the computer, phone, tablet, or other device you use to access the Services, such as your IP address, browser type, hardware model, operating system, internet service provider, and system configuration.

This information is primarily needed to maintain the security and operation of the Services, and for our internal analytics and reporting. Our analytics run on software we host ourselves, so usage data is not sent to a third-party analytics provider. While you are logged in to the editor, we link this usage data to your Discord user ID and username, as described in the Cookie Policy. We also collect information through cookies and similar technologies, which is described in our Cookie Policy.

How We Use Your Information​

We process your personal information to:

  • create and authenticate your account and keep it in working order
  • provide the Services you request
  • understand how the Services are used, so we can improve them
  • fulfill and manage your orders, payments, and refunds
  • protect the Services against abuse, fraud, and security incidents
  • comply with our legal obligations
  • protect an individual's vital interests, such as to prevent harm

We process your information only when we have a valid legal reason to do so, and we may process it for other purposes with your consent.

If you are located in the EU or UK, the GDPR and UK GDPR require us to explain the legal bases we rely on. We may rely on:

  • Consent. You gave us permission to use your information for a specific purpose. You can withdraw your consent at any time.
  • Performance of a contract. Processing is necessary to fulfill our contractual obligations to you, including providing the Services.
  • Legitimate interests. Processing is necessary for our legitimate interests, such as understanding how the Services are used to improve them and protecting them against abuse, and those interests are not outweighed by your interests and rights. You can object to this processing at any time.
  • Legal obligations. Processing is necessary to comply with our legal obligations, to cooperate with law enforcement or a regulatory agency, to exercise or defend our legal rights, or to disclose information as evidence in litigation.
  • Vital interests. Processing is necessary to protect your vital interests or those of a third party, such as situations involving potential threats to the safety of any person.

If you are located in Canada, we process your information based on your express consent, or on implied consent where your permission can reasonably be inferred. You can withdraw your consent at any time. In exceptional cases we may be legally permitted to process your information without consent, for example for fraud detection and prevention, for investigations into a breach of an agreement or a contravention of the law, or where disclosure is required to comply with a subpoena, warrant, or court order.

When and With Whom We Share Your Information​

We do not sell your personal information and we do not share it for advertising purposes.

We share information with the service providers that run the Services on our behalf, such as our payment provider and our hosting and infrastructure providers, under a contract that obliges them to protect it. We may also share or transfer your information in connection with, or during negotiations of, a merger, a sale of company assets, financing, or an acquisition of all or part of our business.

Cookies and Tracking Technologies​

We use cookies and similar technologies (like local storage) to operate the Services and to store your preferences. Details about what we use and how you can refuse cookies are in our Cookie Policy.

How We Handle Your Discord Login​

The Services require you to register and log in with your Discord account. When you do, we receive profile information from Discord, which may include your user ID, username, avatar, email address, and the servers you are a member of or administer.

We use this information only for the purposes described in this notice. We do not control, and are not responsible for, other uses of your personal information by Discord. We recommend that you review their privacy notice to understand how they collect, use, and share your information, and how you can set your privacy preferences.

How Long We Keep Your Information​

We keep your personal information only as long as necessary for the purposes set out in this notice, unless a longer retention period is required or permitted by law (such as tax or accounting requirements). No purpose in this notice requires us to keep your personal information for longer than you have an account with us.

When we no longer have a legitimate business need to process your personal information, we delete or anonymize it. If that is not possible, for example because it is stored in backup archives, we securely store it and isolate it from further processing until deletion is possible.

How We Keep Your Information Safe​

We have implemented appropriate technical and organizational security measures designed to protect the personal information we process. However, no electronic transmission over the internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that unauthorized third parties will never be able to defeat our security and improperly collect, access, steal, or modify your information. Transmission of personal information to and from the Services is at your own risk.

Your Privacy Rights​

In some regions, such as the European Economic Area, the United Kingdom, and Canada, you have rights under applicable data protection laws. These may include the right to request access to and a copy of your personal information, to request rectification or erasure, to restrict processing, to data portability, and in certain circumstances to object to processing. To exercise any of these rights, email us at privacy@message.style. We will consider and act upon any request in accordance with applicable law.

You can review, change, or delete your account at any time. When you ask us to delete your account, we deactivate or delete the account and its information from our active databases. We may retain some information to prevent fraud, troubleshoot problems, assist with investigations, enforce our legal terms, or comply with legal requirements.

If you are located in the EEA or UK and believe we are unlawfully processing your personal information, you also have the right to complain to your Member State data protection authority or the UK Information Commissioner's Office. If you are located in Switzerland, you may contact the Federal Data Protection and Information Commissioner.

If we are relying on your consent to process your personal information, you can withdraw it at any time by emailing privacy@message.style. This does not affect the lawfulness of the processing before the withdrawal, nor the processing of your information on other lawful grounds.

Cookies and Similar Technologies​

Most browsers accept cookies by default. You can set your browser to remove or reject cookies, which may affect certain features of the Services. For details, see our Cookie Policy.

Controls for Do-Not-Track Features​

Most browsers and some mobile operating systems include a Do-Not-Track ("DNT") feature you can activate to signal that you do not want your online browsing activities monitored. No uniform technology standard for recognizing and implementing DNT signals has been finalized, so we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked. If a standard is adopted that we must follow, we will say so in a revised version of this notice.

California Residents​

California Civil Code Section 1798.83, the "Shine The Light" law, permits users who are California residents to request, once a year and free of charge, information about the categories of personal information we disclosed to third parties for direct marketing purposes, and the names and addresses of those third parties. We do not disclose personal information for direct marketing purposes. To make such a request, contact us at privacy@message.style.

If you are under 18, reside in California, and have a registered account, you have the right to request removal of unwanted data that you publicly posted on the Services. Contact us at privacy@message.style with the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed, but it may not be completely removed from all our systems, for example from backups.

Under the CCPA, a "resident" is every individual who is in California for other than a temporary or transitory purpose, and every individual domiciled in California who is outside the state for a temporary or transitory purpose. If that applies to you, the following also applies.

We have not disclosed, sold, or shared personal information to third parties for a business or commercial purpose in the preceding twelve months, and we will not sell or share personal information in the future. We may use your personal information for our own business purposes, such as internal research for technological development; this is not considered "selling."

Your rights with respect to your personal data include:

  • Request to delete. You can ask us to delete your personal information, subject to exceptions provided by law, such as our compliance with a legal obligation or processing required to protect against illegal activity.
  • Request to know. You can ask whether we collect and use your personal information, which categories we collect, the purposes we use it for, whether we sell or share it, the categories of third parties involved, and the specific pieces of personal information we hold about you.
  • Non-discrimination. We will not discriminate against you for exercising your privacy rights.
  • Limiting use of sensitive personal information. We do not process sensitive personal information.
  • Other rights. You may object to processing, request correction of inaccurate or outdated data, ask us to restrict processing, or designate an authorized agent to make a request on your behalf. We may deny a request from an authorized agent who does not submit proof of valid authorization.

Before we act on a request, we need to verify your identity, which means matching the information in your request against the information we already hold, or contacting you through a method you previously provided. We use the information provided in a request only for verification, and delete anything additional as soon as verification is complete.

Virginia Residents​

Under the Virginia Consumer Data Protection Act (CDPA), a "consumer" is a natural person who is a resident of the Commonwealth acting only in an individual or household context, and "personal data" is any information linked or reasonably linkable to an identified or identifiable natural person. If that definition applies to you, the following also applies.

You have the right to be informed whether we are processing your personal data, to access it, to correct inaccuracies, to request its deletion, to obtain a copy of the data you shared with us, and to opt out of processing for targeted advertising, the sale of personal data, or profiling. We have not sold personal data to third parties for business or commercial purposes and will not do so in the future.

To exercise these rights, email us at privacy@message.style. If you use an authorized agent, we may deny the request if the agent does not submit proof of valid authorization. We may request additional information reasonably necessary to verify you and your request. We will respond without undue delay and within forty-five days of receipt; this period may be extended once by another forty-five days where reasonably necessary, in which case we will tell you within the initial period and explain why.

If we decline to act on your request, we will tell you why. To appeal, email privacy@message.style. Within sixty days of receiving an appeal we will inform you in writing of the action taken or not taken, with a written explanation. If your appeal is denied, you may submit a complaint to the Attorney General.

Updates to This Notice​

We may update this privacy notice from time to time. The updated version is indicated by the date below and is effective as soon as it is accessible. If we make material changes we may notify you by prominently posting a notice or by contacting you directly. We encourage you to review this notice regularly.
